Lisa Arrowood and Jed DeWick Obtain Summary Judgment On Behalf of Large Financial Services Firm

Lisa Arrowood and Jed DeWick obtained summary judgment on behalf of a large financial services firm against a former employee seeking nearly $1 million in compensation he claimed he was wrongfully denied.  Alleging that he was owed certain bonus compensation following his termination from employment, the former employee brought claims against the company for breach of contract, breach of the covenant of good faith and fair dealing, misrepresentation, and violation of the Massachusetts Wage Act. Lisa and Jed obtained a Rule 12(b)(6) dismissal of the Wage Act claim at the outset of the case on the grounds that the compensation at issue did not constitute “wages” under the Wage Act. Following discovery, Lisa and Jed moved for summary judgment on all remaining claims, which the Court granted after a hearing on the matter.
