  • Erika Todd is an experienced advocate who has successfully represented clients at all stages of the litigation process. Her experience includes employment, commercial, medical malpractice, and personal injury litigation. In the employment sphere, Erika has represented management and employees in discrimination, retaliation, trade secret, non-competition, and Wage Act cases.

    Erika had an active second chair role in an employment trial and in a commercial arbitration. She also participated in a products liability class action trial, two employment trials, and an employment arbitration by researching pressing legal issues and by writing key jury instructions, motions in limine, and memoranda.

    Erika represented a staffing company in a trade secrets and non-competition case against several employees who had left to create a competing business. Before the close of discovery, she and Raymond Ausrotas secured a favorable settlement for the company, which included an agreement for judgment of over $450,000 in the client’s favor against the newly-created competitor.

    Erika defended a company, one of its employees, and one of its clients in a suit brought by a competitor. The complaint included allegations of a breach of a restrictive covenant. Erika successfully argued at a hearing to oppose the competitor’s motion for a preliminary injunction.

    In another trade secrets and non-competition case, Erika represented a corporate client against its former employee and two competitors. She developed a strong record of circumstantial evidence through meticulous review of documents and metadata.

    With Lisa Arrowood, Erika represented a client in a medical malpractice suit; a young man’s surgeon transected the common hepatic duct during surgery. They secured a settlement of $500,000 pre-suit. Erika represented a cyclist who was hit by a car and sustained permanent scars on his chin and arm, for which there was pre-suit settlements totaling $200,000. Erika also represented a woman who suffered ongoing pain after hip replacement surgery. The woman learned that the artificial hip was defective and that she required a second replacement surgery. Erika helped to secure a pre-suit settlement of over $200,000.

    Erika is active in the legal community. She is a member of the Boston Bar Association, where she serves on the Practical Skills Committee. Erika is also an active member of the board of the Harvard Law School Association of Massachusetts.

    Erika is a 2013 graduate of Harvard Law School (HLS) and was a member of Harvard’s International Law Journal. Prior to graduating, Erika clerked for the law firm of Shapiro Haber & Urmy and worked for the Elder, Health & Disability Unit at Greater Boston Legal Services. She was a three-year volunteer with the Tenant Advocacy Project at HLS, and she served as Director of Membership and Training during her last two years there. Through the Tenant Advocacy Project, Erika provided legal assistance to tenants in public and subsidized housing. Through HLS, Erika interned with the Equal Employment Opportunity Commission, where she collaborated with her supervising attorney and investigators. As a volunteer for Harvard’s Immigration and Refugee Clinical, Erika successfully aided a refugee seeking asylum.
